Several best practices of taking video, & photos include:
- Surveillance Video:
- Look for video surveillance footage from various sources (employer; parking lot of own facility; cameras of building next door; video from a nearby bank)
- Video: (using a mobile phone)
- Narrate what is being filmed, describe objects, size, direction, location, etc.
- Scan slowly 360 degrees to establish the location
- Photos
- Take distance shots and close shots
- Take photos at different angles
- Include item of known dimension for scale
- Make notes about photos taken

- Comfort:
- The goal of ‘comfort’ is the break the ice, take your time, and make the injured worker feel comfortable. You will catch more bees with honey vs vinegar.
- Conversation
- The goal and most important part of ‘conversation’ is LISTENING. Ask open-ended questions, act friendly and do not suggest disbelief of the story. Seek information.
- Confirm
- The goal of ‘confirm’ is to tie-down the story and eliminate gray area later. Repeat what you heard the injured worker say, and have them agree with you. Pursue the “no” answer to eliminate other possibilities from being added later.
- Confront
- The goal of ‘confront’ is to challenge parts of the story that are potentially untruthful. This should only be done after the information gathering stage, and may even be something to skip.
- Conclude
- The goal of ‘conclude’ is to re-summarize the critical points of the conversation. Again, have the injured worker agree with the statements.

The 5 minimum pieces of information to learn and confirm during an injured worker interview include:
- Mechanism of Injury
- Mechanism of injury is the method by which an injury occurred. Have the employee explain the injury in their own words. If he was injured lifting something, how far was he lifting it, was he lifting and twisting at the same time? How heavy was the item?
- Paint a picture together of what created or caused the injury in the first place. Document with no wiggle room
- Witnesses
- Witness List of those at the scene. Start with those at the scene, but other witnesses may have access to Facebook or Instagram, or just know information about the injured worker on whether they can or can’t work. Never stop investigating, witnesses may find out later committing fraud and come forward.
- Body Parts
- Confirm what body parts are injured and No others.
- Previous Injuries
- Obtain Medical records, ER medical records, and perform a Medical canvass
- Healthcare Providers
- Names of doctors injured worker treated with; Can use your medical provider as an asset and leverage medical fraud indicators such as Waddell Signs

“Pursuing the No” means persisting in questioning until the injured worker says “no, that’s it, and nothing else.” Two examples:
- “You stated you injured your right knee and left elbow, are there any other body parts that were injured besides your right knee and left elbow? ”
- Injured worker: No, those were the only parts injured
- “You stated that John, Tim, and Jane were the only witnesses at the scene at the time of injury. Was there anyone else nearby besides John, Tim, and Jane that may have witnessed the accident?”
- Injured worker: No, John, Tim, and Jane were the only people who witnessed the accident.
- “You stated you injured your right knee and left elbow, are there any other body parts that were injured besides your right knee and left elbow? ”
